    Las presentes condiciones (en adelante Aviso Legal) tiene por finalidad regular el uso de la página web de EL TITULAR que pone a disposición del público.

    El acceso y/o uso de esta página web atribuye la condición de USUARIO, que acepta, desde dicho acceso y/o uso, las condiciones generales de uso aquí reflejadas. Las citadas condiciones serán de aplicación independientemente de las condiciones generales de contratación que en su caso resulten de obligado cumplimiento.

    USO DEL PORTAL

    www.babelgroup.com proporciona el acceso a multitud de informaciones, servicios, programas o datos (en adelante, “los contenidos”) en Internet pertenecientes a EL TITULAR o a sus licenciantes a los que el USUARIO puede tener acceso.

    El usuario asume la responsabilidad del uso del portal. Dicha responsabilidad se extiende al registro que fuese necesario para acceder a determinados servicios o contenidos. En dicho registro el USUARIO será responsable de aportar información veraz y lícita. Como consecuencia de este registro, al USUARIO se le puede proporcionar una contraseña de la que será responsable, comprometiéndose a hacer un uso diligente y confidencial de la misma.

    El USUARIO se compromete a hacer un uso adecuado de los contenidos y servicios (p.e. servicios de chat, foros de discusión o grupos de noticias) que EL TITULAR ofrece a través de su portal y con carácter enunciativo pero no limitativo, a no emplearlos para:

    Incurrir en actividades ilícitas, ilegales o contrarias a la buena fe y al orden público.

    Difundir contenidos o propaganda racista, xenófoba, pornográfico-ilegal, de apología del terrorismo o atentatoria contra los derechos humanos.

    Utilizar el sitio web ni las informaciones que en él se contienen con fines comerciales, políticos, publicitarios y para cualquier uso comercial, sobre todo en el envío de correos electrónicos no solicitados.

    EL TITULAR se reserva el derecho a retirar todos aquellos comentarios y aportaciones que vulneren el respeto a la dignidad de la persona, que sean discriminatorios, xenófobos, racistas pornográficos, que atenten contra la juventud o la infancia, el orden o la seguridad pública o que, a su juicio, no resultarán adecuados para su publicación. Por todo ello, EL TITULAR no será responsable de las opiniones vertidas por los usuarios a través de los foros, chats, u otras herramientas de participación.

    En cualquier caso, LA EMPRESA como administrador de su web, actuará diligentemente nada más tenga conocimiento de actos cometidos en contra del presente Aviso Legal o de su Política de Privacidad.

    PROTECCIÓN DE DATOS

    Todo lo relativo a la política de protección de datos se encuentra recogido en el documento de política de privacidad.

    CONTENIDOS. PROPIEDAD INTELECTUAL E INDUSTRIAL

    EL TITULAR es propietario de todos los derechos de propiedad intelectual e industrial de su página web, así como de los elementos contenidos en la misma (a título enunciativo: imágenes, fotografías, sonido, audio, vídeo, software o textos; marcas o logotipos, combinaciones de colores, estructura y diseño, selección de materiales usados, programas de ordenador necesarios para su funcionamiento, acceso y uso, etc), titularidad del TITULAR o bien de sus licenciantes.

    Todos los derechos reservados. En virtud de lo dispuesto en los artículos 8 y 32.1, párrafo segundo, de la Ley de Propiedad Intelectual, todos los contenidos publicados en el sitio web y especialmente los diseños, textos, imágenes, vídeos, gráficos, logos, iconos, botones, así como los nombres comerciales, las marcas o dibujos y cualquier otro signo susceptible de utilización industrial y comercial están sujetos a derechos de propiedad intelectual e industrial de EL TITULAR. En ningún caso se entenderá que se concede licencia alguna o se efectúa renuncia, transmisión, cesión total o parcial de dichos derechos ni se confiere ningún derecho ni expectativa de derecho, y en especial, de alteración, explotación, reproducción, distribución o comunicación pública sobre dichos contenidos sin la previa autorización expresa de EL TITULAR.

    EXCLUSIÓN DE GARANTÍAS Y RESPONSABILIDAD

    EL USUARIO reconoce que la utilización de la página web y de sus contenidos y servicios se desarrolla bajo su exclusiva responsabilidad. En concreto, a título meramente enunciativo, EL TITULAR no asume ninguna responsabilidad en los siguientes ámbitos:

    La disponibilidad del funcionamiento de la página web, sus servicios y contenidos y su calidad o interoperabilidad.

    La finalidad para la que la página web sirva a los objetivos del USUARIO.

    La infracción de la legislación vigente por parte del USUARIO o terceros y, en concreto, de los derechos de propiedad intelectual e industrial que sean titularidad de otras personas o entidades.

    La existencia de códigos maliciosos o cualquier otro elemento informático dañino que pudiera causar el sistema informático del USUARIO o de terceros. Corresponde al USUARIO, en todo caso, disponer de herramientas adecuadas para la detección y desinfección de estos elementos.

    El acceso fraudulento a los contenidos o servicios por terceros no autorizados, o, en su caso, la captura, eliminación, alteración, modificación o manipulación de los mensajes y comunicaciones de cualquier clase que dichos terceros pudiera realizar.

    La exactitud, veracidad, actualidad y utilidad de los contenidos y servicios ofrecidos y la utilización posterior que de ellos haga el USUARIO. EL TITULAR empleará todos los esfuerzos y medios razonables para facilitar la información actualizada y fehaciente.

    Los daños producidos a equipos informáticos durante el acceso a la página web y los daños producidos a los USUARIOS cuando tengan su origen en fallos o desconexiones en las redes de telecomunicaciones que interrumpan el servicio.

    Los daños o perjuicios que se deriven de circunstancias acaecidas por caso fortuito o fuerza mayor.

    En caso de que existan foros, el uso de los mismos u otros espacios análogos, ha de tenerse en cuenta que los mensajes reflejen únicamente la opinión del USUARIO que los remite, que es el único responsable. EL TITULAR no se hace responsable del contenido del los mensajes enviados por el USUARIO.

    MODIFICACIÓN DE ESTE AVISO LEGAL Y DURACIÓN

    EL TITULAR se reserva el derecho de efectuar sin previo aviso las modificaciones que considere oportunas en su portal, pudiendo cambiar, suprimir o añadir tantos contenidos y servicios que se presten a través de la misma, como la forma en la que éstos aparezcan representados o localizados en su portal.

    La vigencia de las citadas condiciones irá en función de su exposición y estarán vigentes hasta que sean modificadas por otras debidamente publicadas.

    ENLACES

    En el caso de que en www.babelgroup.com se incluyesen enlaces o hipervínculos hacia otros sitios de Internet, EL TITULAR no ejercerá ningún tipo de control sobre dichos sitios y contenidos. En ningún caso EL TITULAR asumirá responsabilidad alguna por los contenidos de algún enlace perteneciente a un sitio web ajeno, ni garantizará la disponibilidad técnica, calidad, fiabilidad, exactitud, amplitud, veracidad, validez y constitucionalidad de cualquier materia o información contenida en ninguno de dichos hipervínculos y otros sitios en Internet. Igualmente, la inclusión de estas conexiones externas no implicará ningún tipo de asociación, fusión o participación con las entidades conectadas.

    DERECHOS DE EXCLUSIÓN

    EL TITULAR ser reserva el derecho a denegar o retirar el acceso a portal y/o los servicios ofrecidos sin necesidad de advertencia previa, a instancia propia o de un tercero, a aquellos usuarios que incumplan el contenido de este aviso legal.

    GENERALIDADES

    EL TITULAR perseguirá el incumplimiento de las presentes condiciones así como cualquier utilización indebida de su portal ejerciendo todas las acciones civiles y penales que le puedan corresponder en derecho.

    SEGURIDAD WEB

    La web utiliza técnicas de seguridad de la información comúnmente aceptadas en la industria, tales como firewalls, procedimientos de control de acceso, comunicaciones seguras o mecanismos criptográficos, entre otros, todo ello con el objeto de prevenir y reducir los incidentes de seguridad sobre los datos (confidencialidad, integridad y disponibilidad).     LEGISLACIÓN APLICABLE Y JURISDICCIÓN

    La relación entre EL TITULAR y EL USUARIO se regirá por la normativa española vigente. Todas las disputas y reclamaciones derivadas de este aviso legal se resolverán por los juzgados y tribunales españoles.

    MENORES DE EDAD

    www.babelgroup.com dirige sus servicios a usuarios mayores de 16 años. Los menores de 16 años no están autorizados a utilizar nuestros servicios y no deberán, por tanto, enviarnos sus datos personales. Informamos de que si se da tal circunstancia, EL TITULAR no se hace responsable de las posibles consecuencias que pudieran derivarse del incumplimiento del aviso que en esta misma cláusula se establece. En estos casos, cuando en virtud de la legislación aplicable sea considerado menor de edad, aquél con edad inferior a los 16 años, deberá obtener siempre el previo consentimiento de sus padres, tutores o representantes legales, quienes serán los responsables directos de los actos realizados por los menores de edad. EL TITULAR informa al USUARIO que existen mecanismos, como programas informáticos, filtros, y bloqueos que permiten limitar el acceso a contenidos, y que son de especial utilidad para controlar y restringir los contenidos a los que acceden.

These terms and conditions (hereinafter Legal Notice) are intended to govern the use of the website of the OWNER, which is made available to the public.

Access to and/or use of this web page attracts the status of USER, and the USER accepts, as from said access and/or use, the general terms and conditions of use set out here. The terms and conditions shall apply independently from the general conditions of contracting that may be mandatory.

USING THE PORTAL

www.babel.es provides access to a wide range of information, services, programs or data (hereinafter, “the contents”) on the Internet belonging to THE OWNER or its licensors, to which the USER may have access.

The user assumes responsibility for use of the portal. This responsibility extends to the registration required in order to access certain services or contents. In the course of registration the USER will be responsible for providing truthful and legitimate information. As a result of this registration, the USER may be provided with a password for which he/she will be responsible, and he/she undertakes to use it diligently and confidentially.

The USER undertakes to make appropriate use of the content and services (e.g. chat services, discussion forums or newsgroups) offered by the OWNER via its portal, and by way of illustration but without limitation, not to employ them in order to:

  • Engaging in activities that are unlawful, illegal or contrary to good faith and public order.
  • Disseminating content or propaganda that is racist, xenophobic, pornographic-illegal, advocates terrorism or offends against human rights.

CONTENT. INTELLECTUAL AND INDUSTRIAL PROPERTY

The OWNER owns all intellectual and industrial property rights in and over its website and the elements contained therein (e.g., images, photographs, sound, audio, video, software or texts; trademarks or logos, colour combinations, structure and design, selection of materials used, computer programs required for operation, access and use, etc.), owned by the OWNER or its licensors.

All rights reserved. Pursuant to the Articles 8 and 32.1, subparagraph 2, of the Intellectual Property Act, all content published on the website and in particular designs, texts, images, videos, graphics, logos, icons, buttons, as well as trade names, brands or drawings and any other signs open to industrial and commercial use are subject to the intellectual and industrial property rights of THE OWNER. In no case shall any licence be deemed to be granted or any waiver, transfer, complete or partial assignment of such rights be made or any right or expectation of right be granted, and in particular any alteration, exploitation, reproduction, distribution or public communication of such content without the prior express authorisation of THE OWNER.

EXCLUSION OF WARRANTIES AND LIABILITY

THE USER acknowledges that the use of the website and its contents and services is to be carried out under his/her sole responsibility. Specifically, by way of illustration only, the OWNER assumes no responsibility in the following fields:

  1. The availability of the functioning of the website, its services and contents and its quality or interoperability.
  2. The purpose for which the website serves the USER's aims.
  3. Violation of prevailing laws and regulations by the USER or third parties, and in particular intellectual and industrial property rights owned by other persons or entities.

  8. Damages arising from circumstances arising from acts of God or force majeure.

If there are forums, the use thereof or other analogous spaces, it must be taken into account that the messages reflect only the opinion of the USER sending them, who is the sole party responsible. The OWNER is not responsible for the content of messages sent by USER.

MODIFICATION OF THIS LEGAL NOTICE AND DURATION

The OWNER reserves the right to make any modifications it deems appropriate in its portal without prior notice, and may change, delete or add any content and services provided through it, or change the manner in which they are represented or located in its portal.

The validity of the above terms and conditions is subject to their being disclosed, and those terms will remain in force until they are modified by others published in the proper form.

If www.babel.es includes links or hyperlinks to other Internet sites, the OWNER shall not exercise any control over such websites and content. In no event shall the OWNER assume any liability for the contents of any link belonging to any other website, nor shall it guarantee the technical availability, quality, reliability, accuracy, breadth, veracity, validity or constitutionality of any matter or information contained in any such hyperlinks or other websites on the Internet. Likewise, the inclusion of these external connections shall involve no form of association, merger or participation with the connected entities.

EXCLUSION RIGHTS

The OWNER reserves the right to refuse or withdraw access to the portal and/or the services offered without need of prior warning, at the request of itself or a third party, to users who breach the terms of this legal notice.

GENERALITIES

THE HOLDER will pursue the breach of these conditions and any improper use of its portal exercising all civil and criminal actions that may correspond by law.

We inform you that if such circumstance occurs, BABEL SISTEMAS DE INFORMACION S.L. is not responsible for any possible consequences which may arise from a breach of the notice set out in this clause.

In these cases, where under the applicable law they are considered to be a minor, children under the age of 16 must always obtain prior consent from their parents, guardians or legal representatives, who will be directly responsible for the actions carried out by the child. THE OWNER informs you there are mechanisms such as software, filters and blocks that make it possible to limit access to content and which are particularly useful to control and restrict the content that children log into.
